ROYALTY-FREE LICENSE AGREEMENT
This License Agreement (the “Agreement”) governs the use of the purchased asset pack (the “Asset Pack”).
- GRANT OF LICENSE: Upon purchase, the Licensor hereby grants to the Purchaser a non-exclusive, non-transferable right to use the Asset Pack for personal, educational, and commercial purposes, subject to the limitations set forth in this Agreement.
- USAGE RIGHTS:
- Modification: The Purchaser may modify the assets contained in the Asset Pack. However, such modified assets cannot be resold as standalone products or as part of other asset packs.
- Integration: The Purchaser is permitted to integrate the assets into any interactive content or game, recognizing that the final integrated form is a derivative work.
- Broadcasting: The Purchaser is permitted to display assets in broadcasts, including but not limited to, live streaming platforms and “Let’s Play” content.
- Multi-use: The Asset Pack can be used in an unlimited number of projects by the Purchaser.
- SUPPORT AND UPDATES:
- Updates: While the Licensor may provide updates to the Asset Pack, there is no obligation or promise to release any updates in the future.
- Support: Basic technical support will be provided via e-mail or Discord. The scope and nature of such support will be at the discretion of the Licensor.
- RESTRICTIONS:
- Reselling and Redistribution: The Purchaser shall not resell, redistribute, or repackage the Asset Pack or any modified versions thereof, in whole or in part, without the explicit written permission of the Licensor.
- Logo, Watermark, and Trademark: The Purchaser shall not use the Asset Pack, in whole or in part, as part of a logo, watermark, or trademark.
- NFTs: The Purchaser shall not use the Asset Pack, in whole or in part, for the purpose of minting non-fungible tokens (NFTs) or similar digital assets.
- Generative AI Systems: The Purchaser shall not use the Asset Pack, in whole or in part, for training or feeding generative artificial intelligence systems.
- DISCLAIMER OF WARRANTY AND LIABILITY:
- No Warranty: The Asset Pack is provided “AS IS”, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement.
- No Liability: In no event shall the Licensor be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Asset Pack or the use or other dealings in the Asset Pack.
- GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of Warsaw/Poland. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Warsaw/Poland.
- ENTIRE AGREEMENT: This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous understandings and agreements, whether written or oral, relating to the subject matter hereof.
